1. the prospect of further costs,

2. the inherent risks associated with litigation generally,

3. the emotional stress of being involved in the often slow and costly litigation process.

To that end we help our clients to quickly identify key areas of dispute and advise as early as possible as to the prospects of success attached to those areas. Where possible we encourage mediation even before litigation has commenced. Where early mediation is not possible we use the Court process to assist in further identifying (and usually limiting) areas of dispute before asking the Court to Order that the parties participate in mediation. Our experience has shown that the majority of matters resolve at mediation.

Whilst we see the Court process as assisting in the early identification of issues and progression to a mediated outcome it can be the case that a matter can simply not be settled. In such a case we aggressively use the Court Process to obtain the earliest possible trial dates whilst protecting our clients position through the use of Formal Offers of Settlement that if beaten at trial allow our client to ask for higher costs awards than would otherwise have been ordered.

Critically, early identification of issues is paramount in our ability to provide tactical advice to attempt to resolve the matter. We recommend that our clients meet with us as early as possible in any potential dispute so that we can best advise them in their particular case.
