Property settlement is an issue of major concern in most divorces. Legal advice can help you stay in control.

There is no presumption in Australian law of an equal settlement of property. Every case is different.

The Family Law Courts look at financial contributions and non-financial contributions the parties have made to the acquisition, conservation and improvement of the assets of the marriage.

The court will consider any contribution to welfare of the family, including any contribution made in the capacity of homemaker or parent.

These factors and others are taken into consideration in arriving at a fair and just settlement.

The same principles apply for a settlement outside the Family Court as apply for a settlement inside the Family Court and the Federal Magistrates Court.

We can help if the two of you come to an agreement by putting that agreement in writing for approval by the Family Court without the necessity of an appearance in Court by either you or your former partner.
