Recent changes to the Family Law Act now provide parties in de facto relationships with many of the same rights and protections enjoyed by married couples. Providing certain threshold issues have been met, such as the length of the relationship or when the relationship broke down, the Family Court and Federal Magistrates Court have power to make Orders for property settlement between de facto partners. Matters of child support and orders dealing with where children live are all dealt with by the Family Court and the Federal Magistrates Court.

De facto parties are also able to enter into Binding Financial Agreements (pre-nuptial agreements) with a similar formality to married couples.
